Unions must critically assess an employer’s explanation as to why a workplace accommodation is not possible. Because unions have an elevated legal duty to fairly represent its members in human rights cases, they are required to go the extra step to ensure that every possible measure has been taken to accommodate employees, including in drug-testing circumstances where safety measures must be applied with the duty to accommodate in mind.
