Addiction cases present some of the most challenging workplace issues for employees.  Arbitrators are aware of the medical relationship between addictions, denial and recidivism.  The duty to accommodate employees with addictions is broadening in Canada, and employers must demonstrate that performance issues linked to an underlying addiction or disability will require evidence that all reasonable steps were taken to accommodate the employee before a termination will be upheld.
