Human rights law is clear that collective agreement provisions regarding seniority can and should be waived in circumstances where a shift change is necessary to properly accommodate a junior employee’s disability or family status claim, and no other reasonable accommodation is available. Employers who read collective agreement provisions without applying a statutory human rights perspective may well find themselves on the losing end of a human rights compliant.
