Employers are required to consider all relevant circumstances before terminating an employee. This includes information that arises in the course of a grievance procedure, even after the employee has been terminated. Post-termination evidence will be considered if it is relevant and could provide an explanation for an employee’s errant behaviour leading up to the termination.
